TERMS AND CONDITIONS FOR TRIVIAN GAME PLAYERS

1. Provider of the Trivian Games
The Trivian Games are operated by Futusoft Ltd, hereinafter referred to as Trivian Games.

2. Right to Participate
To participate and play Trivian Games a player must register either on the Trivian Games website or via Trivian Games mobile services by providing normally the following information: name, gender, location, date of birth, e-mail address, interest preferences and the answer to a security question. Also other similar information may be asked if applicable. An account profile will be set up which a player may amend at any time. Trivian Games services may not be used persons under 13 years. Except third party operator costs doing the registration nor the playing does not normally cost anything. However, Trivian Games reserves the right to add new properties in its services which may be subject to a payment by the user. This will be clearly visible in the service.

3. Player Generated Content
By uploading content to Trivian Games the player at the same time grants perpetual exclusive permission for the Trivian Games to use such submission including without any limitation the right to distribute, reproduce, sell, translate or reformat submission(s). Player warrants that he/she has the full copyright in and to the submitted content. Player also represents and warrants he/she has all rights to grant such license to Trivian Games without infringement or violation of any third party rights, including without limitation, any privacy rights, publicity rights, copyrights, contract rights, or any other intellectual property or proprietary rights Trivian Games does not warrant that player submitted content is correct, nor does Trivian Games warrant that user submitted details such as age, location etc. are truthful. Trivian Games is not responsible for any interaction between players on the site.

4. Support and Maintenance Service
To maintain the system and the services Trivian Games may at any time make improvements to the system and the improvements are automatically updated for use by players.

5. Force Majeure
Trivian Games shall not be responsible for failure to perform its part of this Agreement when such failure is directly due to force majeure, for example but not limited to wars, warlike hostilities, civil commotions, riots, strikes, acts of terror, labour troubles, governmental orders, serious problems in telecommunications or material supply or other causes which are beyond the control of Trivian Games. As Trivian Games's force majeure shall also be considered a force majeure of its subcontractor.

6. Immaterial Property Rights
All immaterial property rights and title in and to Trivian Games material in whatever form including the player generated content shall all times belong solely to Trivian Games.

7. Effective Date and Expiration of the Agreement
This Agreement shall automatically enter into force after having been accepted by the player when submitting the registration form with Trivian Games service. The Agreement shall be valid for 1 year after the player has asked Trivian Games in written to remove the player's profile account in the service. At the expiration of the Agreement Trivian Games will remove the players profile from the service but the expiration of the Agreement shall not have any effect on Trivian Games' right to use player generated content. If you have given third party applications or websites access to your information, they may retain your information to the extent permitted under their terms of service. Trivian Games may any time delete a user's profile and deny such user's access to service in case user submits information in the service which include illegal or improper content.

8. Limitation of Liabilities
Trivian Games shall not in any case be liable to any player for any incidental, special nor consequential damages claimed by a third party arising out of the activities according this Agreement.

9. Applicable Law and Arbitration
This Agreement shall be governed by and construed in accordance with the laws of Finland. All disputes arising in connection with this Agreement shall be finally settled by in the local court of justice in Oulu, Finland.

10. Permission to use personal data for direct marketing
The player hereby accepts that his personal data may be used for direct marketing purposes.

11. Binding Agreement
Having carefully read the Agreement above, by continuing registration, I hereby inform to accept the Agreement to be binding.
